The rules
The Town of Melbourne Beach Code, Ch. 40 (Beaches and Waterways), has no metal-detecting or digging rule. It does ban beach driving and walking on dunes (Sec. 40-1, 40-3). On county-managed beach parks in the area, Brevard County Code Sec. 78-120 bans excavation by tool. Under F.S. 267.061(1)(b), abandoned historic artifacts on state lands and submerged lands belong to the state, so shipwreck-era finds can't be kept.
